Ay, brother -- Henry Ian Cusick is off the hook.
Cusick -- who plays Desmond Hume on "Lost" -- has settled a sexual harassment lawsuit with a former production staffer who sued him back in April for allegedly grabbing and touching her inappropriately.
The woman sued Cusick, ABC and a Hawaiian production company. Her lawyer tells us she has settled with all the defendants and the terms are confidential.

In all seriousness, this girl was probably just a crazy bitch. I don't want to sound ignorant, but I find that to be a more likely scenerio than Cusick being stupid enough to risk his entire career and family just to grab some boob for a couple seconds.

Sorry, Yank, that does sound ignorant. Nearly every case of sexual harassment involves someone irrationally risking their career and family just for a meaningless thrill. Most of them probably don't seem "stupid enough" either. We don't know what really happened, but I don't think you can come to any conclusion based on that logic.
I agree you can't say either way who was at fault.
Being a fan of Henry Ian Cusick, I hope it wasn't him but who knows.
Regardless, I'm glad it's over.
I bet this is why he speant so little time on LOST last season. I find it harder every day to believe that the writer's wants and intentions outweigh actor's current availability. This is supported by the fact there was A TON of story on Eko that we missed out on when he no longer wanted to be in the show..

Matthew, according to the article the girl sued him in April.. of 2008. So that would not explain why he spent so little time on LOST. They were pretty much already done filming every single episode by that point, and if not, they were all written.
This is lawsuit has been a serious and sad situation indeed...The actual truth is known only between Cusick and his accuser, really...These cases rarely do see the inside of a courtroom, however. I love Ian Cusick's work on LOST, and hope to see MUCH more of Desmond in the final season!
(Incidentally. I do not believe Desmond's lack of screen time in S5 has anything to do with this issue...I think that the writer's were focusing on different story arcs...Remember how little we saw of Sayid in S3?)
I am happy it's over. They settled, of course they did, who wants scandal, right? And it's not like anybody can prove anything after a whole year (unless she still keeps his fingerprints on her bra... I definitely would :p )
I don't believe that this had anything to do with his screen time in S5. Although the incident must have happened last year, he was sued only in April. And I do hope we will see him more next season.
Oh, and call me naive, but I'm on his side. If I was to think that he is capable of such things, it would be the undoing of everything I know of him. So I chose to believe he is innocent. It makes me happier.
I think his Screen-time was directly effected by this, not in the sense that he was tied up in a legal battle during filming time, but more in a sense that because of the possibility of incarceration and or Dismissal of HIC the Writers had to give Desmond an escape clause I/E Let him be happy off the island, but also leave him hanging in the hospital, giving us three possible scenarios, 1) He never goes back regardless of what Eloise said...2) he goes back to kill Ben and make right his attempt at killing his wife...3)he succumbs to his Gunshot wound and dies.
But had HIC went to court, and been found guilty, he may have had to spend some time behind Bars, and then that would certainly screw with filming, so like I said the writers toned his character down, just in case.
That is the most logical explanation of why Des played so little a part in season 5.
